Understanding the property purchase process
Buying property in Spain involves several legal, administrative
and practical stages. For foreign buyers, the process may be
different from the system in their country of residence and
should be approached with appropriate legal guidance.
Each transaction must be assessed individually. The steps
involved may vary depending on the property, the parties, the
documentation available, the financing structure and the
timing of the purchase.
Abad Associats Lawyers assists international clients throughout the legal aspects of the buying process, providing independent advice before documents are signed, payments are made or completion takes place.

If the property requires renovation, rehabilitation or construction works, it is important to review the legal implications before entering into any agreement with builders, contractors or other professionals.

The purchase is usually completed before a Spanish notary through the signing of the public deed of sale. At this stage, the buyer pays the balance of the price and the seller transfers ownership, subject to the terms agreed and the documentation required for completion.
06Taxes and registration
After completion, the applicable taxes and expenses must be dealt with, and the purchase should be registered with the Land Registry. These post-completion steps are important in order to ensure that the buyer’s ownership is properly recorded.

FAQ’s
Answers to common questions from international clients considering the purchase of property in Spain.
Although legal advice is not mandatory in every property purchase in Spain, it is highly advisable, especially for foreign buyers. Independent legal advice can help review the documentation, clarify the legal situation of the property and identify potential risks before signing any binding document or paying a deposit.
Yes. International clients can purchase property in Spain. The process may involve legal, administrative and practical requirements that differ from those in the buyer’s country of residence, so it is advisable to review the transaction and the relevant documentation before making a binding commitment.
Ideally, you should contact a lawyer before signing a reservation agreement, private purchase contract or any other document, and before making any payment. Early legal advice allows potential legal or practical issues to be reviewed before the buyer assumes contractual or financial obligations.
The appropriate checks depend on the property and the circumstances of the transaction. They may include ownership, registered charges, debts, planning matters, cadastral information, notarial documentation, community matters and any other relevant legal issues affecting the property.
Yes. Many foreign buyers are not in Spain during part of the purchase process. Abad Associats Lawyers can provide legal guidance remotely and, where appropriate, assist with matters related to representation through a Power of Attorney.
